Work from Home Scam
It’s a matter of grave concern that thousands of families are undergoing extreme harassment by fraudsters.
Consumers should realize that the callers are absolute scammers and they have no right to collect the debt and THEY ARE NOT ACTUALLY COLLECTING A DEBT, EITHER! The callers are part of the criminal network which runs extortion operations. What they are attempting to is PURE EXTORTION, in the guise of collecting debt.
Do note that, even if you had defaulted on any payment, you are protected by ‘Statute of Limitations’ under which debt collectors have a limited number of years to sue you to collect. After that period, your unpaid debts are considered ‘time-barred’ and a debt collector cannot sue you for not paying that debt.
This ‘limitation period’ starts from the time of your last payment, not from the time of your first payment.
Having taken a loan several years ago, you must be protected by ‘Statute of Limitations’.
Please go through this article by the FTC. Time barred debts – Statute of Limitations (www. consumer.ftc.gov/articles/0117-time-barred-debts)
Debt collectors are legally bound to send Debt Validation Notice by mail (not email) within 5 days of their first call. Those who call and threaten legal action are hoodlums looking for pain free income, if they can’t even send you a notice. The fact is they can’t since they have no information aside from your phone number and may be name and a couple of other stolen data.
A telephonic demand to pay, without supporting paperwork, has no legal validity.
If the scammer calls again, inform him/her that the call is being taped as advised by the Police and you have filed formal complaint with the Sheriff’s office as well as State Attorney General’s office and the police is on their trail. Be strong. Raise your voice. Change your tone.
These scammers are scared of the police and they will desist calling people who they know have seen through the scam!
(Do file complaint with Local Sheriff’s, State Attorney General’s Office and also at FTC. Do it today!)
